CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA FOR JOB APPLICANTS

Qua Granite Hayal Yapı ve Ürünleri Sanayi Ticaret A.Ş. (“Qua Granite” or the “Company”) processes personal data within the limits prescribed by the Personal Data Protection Law No. 6698 (“Law”), secondary regulations issued under this Law, the decisions of the Personal Data Protection Board, and other relevant legislation. This Clarification Text has been prepared by the Company, in its capacity as the Data Controller, in order to inform you, job applicants, about the processing of your personal data you have shared, in accordance with Article 10 of the Law.

PROCESSED PERSONAL DATA

Your personal data in the categories of Identity (name, surname, date of birth, age, driver’s license status, military service status), Contact (address, phone number, e-mail address), Visual and Audio Records (photograph), Professional Experience (education information, foreign language skills, computer skills, work experience), Finance (salary expectation), and your reference information may be processed.

PURPOSE AND LEGAL BASIS FOR PROCESSING PERSONAL DATA

Your personal data may be processed for the purposes of evaluating your CV’s suitability for the applied position, conducting reference checks, contacting you regarding your job application, carrying out recruitment processes, and implementing our Company’s human resources policies. Such processing is based on the data processing conditions set forth in Article 5, Paragraph 2, subparagraphs (b) “being necessary for the establishment or performance of a contract” and (f) “being necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject” of the Law.

METHOD OF COLLECTING PERSONAL DATA

Your personal data may be collected in written, verbal, electronic, or other forms, through fully or partially automated or non-automated means, such as delivering your CV to our Company by hand, sending it via e-mail, filling out the form on our website, etc.

TO WHOM AND FOR WHAT PURPOSES PERSONAL DATA MAY BE TRANSFERRED

Your personal data may be transferred to our group companies and other companies with which we have organic ties and/or similar partnership structures, for the purposes of evaluating your job application and contacting you regarding your application. In addition, if required during the evaluation process of your application and upon request, your personal data may be shared with legally authorized public institutions and organizations for the fulfillment of legal obligations.

RETENTION PERIOD OF PERSONAL DATA

Your personal data will be retained for a period of 1 (one) year for the purposes of evaluating your application and contacting you in case a suitable position arises in the future. If your application is accepted and an employment relationship is established with the Company, your personal data will be transferred to your personnel file. In this regard, you will be informed through the Employee Clarification Text. At the end of the determined retention periods, your personal data will be destroyed in accordance with periodic destruction periods and the specified destruction methods (deletion and/or destruction and/or anonymization).

The responsibility for informing and obtaining consent from the persons you have provided as references belongs to you.

YOUR RIGHTS AS A DATA SUBJECT

By applying to our Company, you have the right to learn whether your personal data are processed, to request information if your personal data have been processed, to learn the purpose of processing your personal data and whether they are used in accordance with their purpose, to know the third parties to whom your personal data are transferred domestically or abroad, to request correction of your personal data if they are incomplete or incorrectly processed and to request that the transaction carried out in this context be notified to third parties to whom your personal data have been transferred, to request the deletion or destruction of your personal data if the reasons requiring their processing cease to exist despite being processed in accordance with the Law and other relevant legislation, and to request that the transaction carried out in this context be notified to third parties to whom your personal data have been transferred, to object to the emergence of a result against you by analyzing the processed data exclusively through automated systems, and to request compensation for damages if you suffer damage due to the unlawful processing of your personal data. CLARIFICATION TEXT REGARDING THE SENDING OF COMMERCIAL ELECTRONIC COMMUNICATIONS

Qua Trading Ticaret Anonim Şirketi (“Qua Trading” or the “Company”) exercises due diligence in the protection of personal data. This Clarification Text has been prepared by Qua Trading, in its capacity as the Data Controller, in order to fulfill its obligation to inform under Article 10 of the Personal Data Protection Law No. 6698 (“Law”) and to inform data subjects about their rights listed in Article 11 of the Law.

1. Categories of Personal Data Processed and Purposes of Processing Your Personal Data

Your personal data within the categories of Identity (name, surname), Contact (e-mail address, phone number, address), Customer Transaction (order information, request information), Marketing (your preferences and habits regarding products and services, survey responses, information obtained through campaign activities), and Professional Experience (profession, company/position) may be processed by Qua Trading for the purposes listed below, provided that you give your explicit consent;

Sending commercial electronic communications (via SMS, e-mail, phone, etc.) within the scope of the Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, for the purpose of conducting advertising, campaign, and promotion processes related to products and services,
Analyzing customer habits and preferences to provide personalized offers within the scope of product and service marketing processes,
Conducting and managing customer relationship management (CRM) analyses,
Carrying out activities aimed at customer satisfaction,
Sending promotions, surveys, and e-newsletters of Qua Trading

2. Methods and Legal Basis for Collecting Personal Data

Your personal data may be collected through verbal communication, paper, data collection forms, website, social media, phone, e-mail, and other electronic or non-electronic methods, and may be processed based on your explicit consent pursuant to Article 5/1 of the Law. If you give your explicit consent, you have the right to withdraw your consent at any time without providing any justification. You may also change your electronic communication preferences.

3. To Whom and For What Purposes Personal Data May Be Transferred

If you give your explicit consent, your personal data obtained may be transferred to relevant suppliers from whom service support is received, group companies, and other companies with which Qua Trading has organic ties and/or similar partnership structures, for the purpose of fulfilling the data processing purposes set forth in this Clarification Text.

4. Rights of the Data Subject Listed in Article 11 of the Law

Data subjects have the right to learn whether their personal data are processed, to request information if their personal data have been processed, to learn the purpose of processing their personal data and whether they are used in accordance with their purpose, to know the third parties to whom personal data are transferred, to request correction of their personal data if they are incomplete or incorrectly processed, to request deletion or destruction of their personal data in accordance with the legislation, to object to the emergence of a result against them through the analysis of their personal data, and to request compensation for damages in case of unlawful processing of their personal data.
